Processing of personal data

Your privacy is important to us. That is why we want you to know what personal data we process about you, why we need it, how long we keep it, and who may have access to it.

These policies apply primarily to the websites and development projects under the IP Polná INVEST brand.

When processing personal data, we proceed in accordance with:

• Regulation (EU) 2016/679 of the European Parliament and of the Council, known as the GDPR,
• Act No. 110/2019 Coll., on the Processing of Personal Data,
• Act No. 480/2004 Coll., on Certain Information Society Services, which governs, among other things, the sending of commercial communications,
• and other related legal regulations.

1. Who processes your data

(hereinafter referred to as "IP Polná" or the "Controller").

 is part of the IP Polná group. Therefore, other companies within the group may also participate in individual development projects – for example, companies that own the project, act as investors, or are the sellers of a specific property.

2. What data we may process about you

It depends on how you communicate with us and the stage of your interest in a property.

When you send us an inquiry

We typically process:

• first and last name,
• email address,
• phone number,
• the project or property you are interested in,
• the content of your message,
• the history of our subsequent communication,
• information about how you found us – for example, from which website, advertisement, or campaign,
• the date and time your inquiry was sent,
• other information that you provide to us voluntarily.

When you become our client

We may also require, for example:

• date of birth,
• residential address,
• data necessary for your identification,
• data provided in contracts,
• payment and bank details,
• information related to property financing,
• data regarding client changes,
• information necessary for the handover of the property and subsequent client service.

We always strive to work only with the data we truly need for a given purpose.

3. When you are interested in an apartment or other property

If you send us an inquiry via our website, email, or phone, we use your data primarily to:

• respond to you,
• provide information about a project or a specific property,
• arrange a meeting or viewing with you,
• offer you a suitable property within a project you are interested in,
• continue our business communication,
• or to prepare a reservation or contractual documentation.

In this case, the legal basis is primarily Article 6(1)(b) of the GDPR, which covers taking steps at your request prior to entering into a contract.

We do not need your marketing consent to process a standard inquiry.

If we do not ultimately reach an agreement on a purchase and there is no other reason for us to continue storing your data, we will retain the data related to your inquiry for a maximum of 12 months from our last relevant contact.

4. How we handle inquiries in our CRM

We use a CRM system to record and manage inquiries.

It helps us keep track of, for example:

• your contact details,
• the project or apartment you are interested in,
• communication history,
• the stage of the business process,
• meetings and other business activities,
• the source of your inquiry,
• the advertising or marketing campaign you came from,
• marketing consent and its potential withdrawal.

We also use this data for internal statistics, reporting, and evaluating which marketing activities are effective.

Depending on the specific situation, the legal basis may be, in particular, Article 6(1)(b) of the GDPR or our legitimate interest under Article 6(1)(f) of the GDPR, for example, for the efficient management of the business process, evaluation of our services, and protection of legal claims.

5. When you reserve or purchase a property

If you decide to reserve or purchase a property, we also need your details for the subsequent steps related to the transaction.

This includes, for example:

• preparation and signing of contracts,
• communication during construction,
• client changes,
• client service,
• financing the purchase,
• handover of the property,
• handling complaints or other requests,
• fulfillment of accounting, tax, and other legal obligations.

In connection with a specific project, data may also be transferred to the relevant project company within the IP Polná group.

The legal basis may primarily be:

• Art. 6(1)(b) GDPR – performance of a contract,
• Art. 6(1)(c) GDPR – compliance with a legal obligation,
• Art. 6(1)(f) GDPR – our legitimate interest, such as the protection of our legal claims.

We retain data for the duration of our contractual relationship and subsequently for the period required by law or necessary for the protection of our rights.

6. News and offers from IP Polná projects

If you provide your consent, we may send you news and offers regarding projects by IP Polná and its group companies.

This may include, for example:

• new and upcoming development projects,
• current listings of apartments and other properties,
• news from individual projects,
• invitations to open house events and other activities,
• offers related to housing and real estate.

For this purpose, we may use in particular:

• first and last name,
• email,
• phone number,
• information about the projects or types of properties you were interested in,
• information about your marketing preferences,
• information about how you found us.

The legal basis is your consent under Article 6(1)(a) of the GDPR.

The sending of electronic commercial communications is also governed by Section 7 of Act No. 480/2004 Coll., on Certain Information Society Services.

How long the consent is valid

You grant marketing consent for a period of 10 years from the date it is granted or last renewed, or until it is withdrawn, whichever comes first.

You can withdraw your consent at any time, easily and free of charge:

• by clicking the unsubscribe link in any marketing email,
• or by writing to info@ippolna.cz

Withdrawing your consent will not affect your inquiry, reservation, property purchase, or any other contractual relationship with us.

We may retain information about your granting or withdrawing consent to the extent necessary to demonstrate that we have respected your decision.

7. If you are already our customer

If you become our customer, we may use your electronic contact details to send you offers for our own similar products or services, under the conditions set out in Section 7(3) of Act No. 480/2004 Coll.

However, we will always provide you with a simple and free way to opt out of further communications.

You may also object to the processing of your personal data for direct marketing purposes at any time in accordance with Article 21 of the GDPR.

8. Data sharing within the IP Polná group

Various companies within the IP Polná group participate in individual development projects.

Your data may therefore be disclosed to other group companies to the extent necessary, for example if:

• it is developing the project you are interested in,
• it is the owner or seller of the property in question,
• its involvement is necessary for the reservation or purchase of a property,
• it provides client services,
• you have consented to marketing communications regarding projects of the group's companies,
• there is another appropriate legal basis.

We do not share personal data between group companies automatically or without restriction. Every use of data must have a specific purpose and a legal basis in accordance with Article 6 of the GDPR.

If two or more companies jointly determine the purposes and means of processing specific personal data, they may be considered joint controllers under Article 26 of the GDPR.

We continuously update this list according to the current structure of our projects and companies.

10. Who else may have access to the data

We also use external suppliers for website operations, client communication, marketing, and other services.

These may include, for example:

• CRM system provider,
• email service provider,
• web hosting and IT service providers,
• analytics and advertising platforms,
• marketing and advertising agencies,
• business partners,
• legal, accounting, and tax advisors.

If these providers process data on our behalf, they act as processors and must comply with the requirements of Article 28 of the GDPR.

The main services we may use for our development projects include, in particular:

• Realpad – CRM and business process management,
• Ecomail – email communication and marketing,
• Google – analytics and advertising services,

Specific services may vary depending on individual projects and websites.

11. Cookies

We use cookies and similar technologies on our website.

We use cookies necessary for the proper functioning of the website without consent, where permitted by law.

We use analytical and marketing cookies according to your settings and based on your consent, where required.

Thanks to them, we can, for example, determine:

• how many people visit the website,
• which pages visitors are interested in,
• where they arrived from,
• which advertising campaign they came from,
• how they interact with the website.

12. Transfer of data outside the European Economic Area

Some of our technology or marketing partners may also process personal data outside the European Economic Area.

If this occurs, we follow the rules set out in Art. 44 et seq. of the GDPR and apply appropriate data protection safeguards.

13. What are your rights

The GDPR grants you a number of rights. Provided the relevant conditions are met, you may in particular:

• request access to your data – Art. 15 GDPR,
• request data correction – Art. 16 GDPR,
• request erasure – Art. 17 GDPR,
• request a restriction on processing – Art. 18 GDPR,
• request the portability of your data – Art. 20 GDPR,
• object to processing – Article 21 of the GDPR,
• withdraw your consent at any time – Article 7(3) of the GDPR.

If we use your data for direct marketing, you may object to this at any time in accordance with Article 21(2) of the GDPR. We will then stop using your data for this purpose.

We may update these policies from time to time, for example, if there are changes to the technologies used, the way we handle personal data, the structure of the IP Polná group, or legal regulations.
